Terms & conditions
These terms apply to every order placed through nackabatzi.com. Please read the section on custom-made goods, because it affects your right to cancel.
1. Who you are contracting with
Nackabatzi, based in Vienna, Austria, reachable at contact@nackabatzi.com. Full company details are available on request and will be published here as soon as our registration is complete.
2. How an order is formed
You build a suit in the customizer and send us the request together with your measurements. That is an offer, not yet a contract. The contract starts when we confirm your order by email. We may decline an order, for example if your measurements are incomplete or implausible.
3. Prices and payment
Prices are in euro and include Austrian VAT where applicable. Shipping is quoted separately with your order confirmation. Payment is due in full before production begins, unless we agree otherwise in writing.
4. Your measurements
We build the suit to the 28 measurements you give us. Please follow the measurement guide carefully and ask a second person to help. If a suit does not fit because the measurements supplied were wrong, any alteration or remake is chargeable.
5. Production and delivery
Lead time is normally 4 to 6 weeks from the day we have your confirmed measurements and payment. Lead times are estimates, not guaranteed dates. We ship across the EU. For deliveries elsewhere, contact us first.
6. Right of withdrawal
Every Nackabatzi suit is made to your personal measurements and specification. Under §18(1)(3) of the Austrian Distance and Off-Premises Contracts Act (FAGG), which implements Art. 16(c) of Directive 2011/83/EU, there is no 14 day right of withdrawal for goods made to a consumer's specification or clearly personalised. Once production starts, your order cannot be cancelled.
Before production starts you may cancel in writing. We refund what you paid, less any material already cut for your order.
7. Warranty and defects
Statutory warranty rights under Austrian law apply: two years from delivery for manufacturing defects. Tell us at contact@nackabatzi.com and we will repair, replace or refund. Normal wear, crash damage and damage from incorrect care are not covered.
8. Protective equipment
Our suits carry CE Level 2 armour and abrasion-tested leather. No protective clothing prevents all injury. Ride within your ability, and replace a suit that has taken a serious impact.
9. Governing law
Austrian law applies, and mandatory consumer protection rules of your own country of residence remain unaffected. Place of jurisdiction for merchants is Vienna.
10. Changes
We may update these terms for future orders. The version you agreed to at the time of your order confirmation is the one that applies to that order.
